Abstract


Act in Terms of Islamic and Positive Law and in the Context of General Crime Theory
The general theory of crime refers to general and common rules applicable to all types of crime. Therefore, “the subject of general crime theory” is to examine whether an unlawful act constitutes a crime. The basis of the criminal responsibility of the offender in criminal law is its own voluntary behaviour. Therefore, the criminal law deals with the act, not the offender. The legislator gives place to the human act, which is a movement element in every type of crime it creates. Because there can be no mention of a crime without an act (nullum crimen sine actione). In this study, it will be tried to reveal the act and its nature which are subject to punishment in terms of positive law and Islamic law.
