Abstract


Holistic View on Decrees of Obligation (al-Ahkam al-Taklifiya): Al-Shatibi as an Example
Al-Shatibi, basis all judgements on the holistic principles, and maslaha (public interest) he also addresses the decrees of obligation by this perspective. In this context, five decrees of obligation (al-Ahkam al-Taklifiya) are explained by giving examples. Each of these fıve obligations have their own laws but when holistically viewed they have different judgments. This variation is due to them serving the original holistic principles. Thus, an obligatory action (wajib) if continuously abandoned by individuals or a community damaging the holistic principles, the judgment on this action will change. Vice versa a forbidden action (haram) if it continuously committed then the judgment will be more sever. In the same way an action that is deemed permitted (mubâh) but is done continuously against what it was intended for, will cause a change on the judgment deeming it either: recommended (mandub), obligatory (wajib), disapproved (makruh) or forbidden (haram).
